Litigation representation in civil and arbitration proceedings

Buharova Irina Viktorovna, Kozlowva Valerija Aleksandrovna
Representation in court has a long history of development. It has its origins in Roman private law and has been extensively discussed and studied throughout its long history. The centuries-old history of this institution demonstrates the purpose of the emergence of representation in the process of court proceedings and contains the most important approaches to determine the place of representation during the consideration of a civil case by the court. The Constitution of the Russian Federation has not only enshrined the rights and freedoms of citizens, but also defined the guarantees for their exercise. One of such guarantees is the right of citizens to legal protection. The fullest exercise of the citizen's right to legal protection is largely facilitated by qualified legal assistance, the right to which is enshrined in Article 48 of the Constitution of the Russian Federation. Qualified legal assistance is rendered to citizens in various forms, including in the form of judicial representation in civil cases.
