PRIVACY AND THE RIGHT TO BE FORGOTTEN

Maria Chiara Nevola
It starts with the concept of the right to be forgotten which is closely related to that of privacy. In the exposition, various topics are touched upon starting with an examination of the Jurisprudence regarding privacy, both at the level of European Union sources, and our Italian national Jurisprudence continuing with the exposition of: identity, tasks and powers; regarding the Supervisory Authorities in the European and national spheres. In the last paragraph of the chapter, the legal tensions that have arisen over the concept of sensitive data processing, following the outbreak of the Sars-Covid-19 pandemic, are expounded. Finally, the paper addresses in more detail the topic the right to be forgotten. It begins by exposing the concept of the data subject's consent to the processing of data, a processing that should be implemented in a transparent manner by the data owner, they then examine, the rights of the data subject, with particular attention paid precisely to the right to be forgotten and the deletion of data from search engines.Ultimately, they consider the limitations to the data subject's rights.
